Prompt action may be required
The New York statute of limitations for medical malpractice lawsuits is two and one-half years from the date of medical error or injury. This means that, with certain limited exceptions, a lawsuit must be commenced within that time frame. Indeed, where the injury resulted in death, surviving relatives must file a wrongful death lawsuit within two years of the date of death.
